By completing the Sound Feelings Publishing Affiliate Program registration process, you are agreeing to be a part of Sound Feelings Publishing’s Affiliate Program in a manner consistent and in agreement with the terms and conditions outlined and stated in this Agreement. By checking the “I have read and agree to the Sound Feelings Publishing’s Affiliate Program Terms of Service Agreement.” checkbox, you are also agreeing to abide by all applicable laws and regulations. Only by consenting to this Agreement will you be able to participate in Sound Feelings Publishing’s Affiliate Program. Please read carefully before continuing.
Site Qualifications.
- All sites will be eligible for the Sound Feelings Publishing Affiliate Program except:
- Sites that contain or endorse violation of the law.
- Sites that contain or endorse violence.
- Sites that contain or endorse sexually explicit material.
- Sites that contain or endorse discrimination based on gender, age, race, origin, religion, physical or mental disabilities, or sexual orientation.
- Sites that endorse or participate in the distribution of bulk unsolicited email (spam).
- Sites that are otherwise are considered offensive or inappropriate at Sound Feelings Publishing’s sole discretion.
You May NOT Sell Our Products on Amazon, Ebay or any other 3rd Party Online Site (Other Than Your Own Site.)
You are not permitted to sell our products on Amazon, Ebay, or any other 3rd party online site (other than your own site.) This would be “competing” with our own sales efforts. If you do this, your affiliate account will be TERMINATED.
No Illegal Activity Will Be Tolerated!
PLEASE NOTE: WE DO NOT TOLERATE ILLEGAL ACTIVITY USING CREDIT CARDS. IF YOU ATTEMPT TO USE STOLEN CREDIT CARDS TO PURCHASE PRODUCTS FOR YOURSELF OR FOR OTHER PEOPLE AND THEN CLAIM THE AFFILIATE COMMISSIONS WE WILL (1) NOT HONOR THE COMMISSIONS AND (2) REPORT YOU TO INTERNATIONAL CREDIT CARD FRAUD DEPARTMENTS.
We Can Monitor Your Site.
You agree that we have the right to monitor your site at any time and from time to time to determine if you are following the terms and conditions of this Agreement and to notify you of any changes to your site that we feel should be made.
Commission Payments.
Your affiliate commissions are paid by check on the 10th of each month. When the total commissions due to you at the end of a monthly cycle exceed $50.00, we will send you a commission check for such amount. It is your responsiblity to pay any taxes due. If your commissions in any month are less than $50.00, we will hold those commissions and send you a commission check at the end of a future cycle when your aggregate commissions exceed $50.00. When this Agreement ends, any commissions due at the time of termination will generally be paid at the end of the month following termination, but we may hold your final payment for a longer period of time to ensure that the correct amount is paid. If a customer disputes or rejects a purchased item, and we have already paid you a commission fee based on the sale of that item, we will deduct the amount of the disputed commission from your next monthly commission fee payment. If there are no subsequent commission fees due to you, we will send you a bill for the amount commission, and you agree that you will pay that bill no later than thirty (30) days after you receive it.
Do Not Copy The Look Of Our Site.
You agree that you will not copy, and that your site will not resemble, the look and feel of our site. You will not create the impression from the appearance of your site, or from any content in your site, that your site is our site or a part of our site.
The Starting Date Of This Agreement.
This Agreement will begin upon our acceptance of your Affiliate Application.
Termination Of This Agreement.
This agreement can be ended by either party AT ANY TIME, with or without cause, by giving the other party written notice. Written notice can be in the form of mail, email or fax.
We Can Modify This Agreement.
We may modify any of the terms and conditions in this Agreement, at any time and from time to time, in our sole discretion. You will be notified by email of any modification and a change notice will be posted on our website. Modifications may include, but are not limited to, changes in the scope of commission fees, payment procedures, and the Sound Feelings Publishing Affiliate Program rules. IF ANY MODIFICATION IS UNACCEPTABLE TO YOU, YOUR ONLY OPTION IS TO END THIS AGREEMENT. YOUR CONTINUED PARTICIPATION IN THE SOUND FEELINGS PUBLISHING AFFILIATE PROGRAM FOLLOWING THE POSTING OF THE CHANGE NOTICE OR NEW AGREEMENT WILL INDICATE YOUR ACCEPTANCE OF THE CHANGES.
Service Interruption.
Sound Feelings Publishing will make every effort to keep our web site and services online. However, when technical difficulties, problems or upgrades occur, they may result in a temporary interruption of service. The Affiliate and End User shall not hold Sound Feelings Publishing, nor its service partners liable for any consequence whether direct or indirectly a result from such a disruption of service. You are responsible for notifying Sound Feelings Publishing of any technical problems.
Limitation Of Liability.
Sound Feelings Publishing shall not be liable for any direct, indirect, incidental, special, consequential damages that results from the use, inability to use the service, unauthorized access or tampering of data, any data sent or not sent, any data received or not received, or any transactions through the service. The limitation of liability is covered by the fullest extent permitted by applicable law but not limited to negligence. Sound Feelings Publishing is not liable for any contents or conducts of its members. If you are dissatisfied with the service, or the contents on the service, or with the terms and conditions, your sole resolution is to discontinue using Sound Feelings Publishing by terminating this Agreement. Each Party shall promptly inform the other Party of any information regarding the Affiliate Program that has the potential of leading to a claim, demand, or liability to either Party, or third party. The Affiliate will indemnify, defend, save and hold harmless Sound Feelings Publishing, its officers, its directors, its agents, its affiliates, its distributors, its partners, and its employees from and against all third party claims, demands, liabilities, cost or expenses, including legal counsel fees, resulting from the indemnifying party’s material breach of any duty, representation, or warranty of this Agreement.
